These Terms govern your use of the Optimaize beta service provided by Scail. By creating an account, submitting data, or using Optimaize, you agree to these Terms.
Optimaize analyzes AI agent execution and workflow information and may generate findings, optimization recommendations, candidate workflows, estimates, or other analysis. Optimaize is currently a beta service. Features, functionality, availability, and outputs may change as the product develops.
You retain ownership of information, traces, workflows, prompts, outputs, files, and other content you submit to Optimaize. You grant Scail the limited rights necessary to host, process, analyze, transmit, and otherwise use Customer Content to provide, secure, maintain, and support Optimaize for you. This license ends when Customer Content is deleted, except for limited information retained for security, backup, legal, or compliance purposes. Scail does not sell Customer Content or use it to train general-purpose AI models.
You are responsible for the Customer Content you submit and represent that you have the rights, permissions, and lawful authority necessary for Scail and its service providers to process it as described in these Terms and our Privacy Policy. You must not intentionally submit passwords, private authentication credentials, malicious software, payment card data, protected health information, or other specially regulated information unless Scail has expressly agreed in writing to accept it.
Optimaize uses automated analysis, including AI assisted analysis. Findings, recommendations, cost estimates, latency estimates, candidate architectures, and other outputs may contain errors or may not be appropriate for every environment. You are responsible for reviewing recommendations and deciding whether and how to implement them. Optimaize should not be treated as an autonomous production change system.
Scail will use Customer Content only as described in these Terms and our Privacy Policy and will take reasonable measures designed to protect it from unauthorized access or disclosure. Optimaize relies on third-party infrastructure, cloud, and AI service providers, and your use may therefore involve processing by these providers as necessary to provide the service. Additional information about trace processing, model providers, security, and retention is available in our Trace Data & Security documentation.
Scail retains all rights in Optimaize, including its software, analysis methods, algorithms, models, interfaces, documentation, and underlying technology. Subject to these Terms, you may use the findings, recommendations, and analysis generated for you in connection with your own systems and business. Nothing transfers ownership of your Customer Content to Scail. If you voluntarily provide suggestions or feedback, Scail may use that feedback to develop and improve the service; providing feedback does not give Scail the right to use your Customer Content for model training.
Because Optimaize is in beta, the service is provided without a service-level commitment and may occasionally be modified, interrupted, limited, or unavailable. Scail may suspend access when reasonably necessary to protect the service, investigate misuse, or maintain security.
To the extent permitted by law, Optimaize is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. Scail will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from use of the beta service. Scail’s aggregate liability will not exceed the greater of the amount paid by you during the twelve months preceding the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain exclusions or limitations, so these limitations may not apply in every circumstance.
You may stop using Optimaize at any time. Scail may suspend or terminate access for violation of these Terms, misuse of the service, security risk, or discontinuation of the beta. Customer Content will be handled following the retention practices described in our Privacy Policy and Trace Data & Security documentation. We may modify these Terms as the beta service evolves. Material changes will be posted with an updated effective date or otherwise communicated when appropriate. Continued use after revised Terms take effect constitutes acceptance of the revised Terms.
